District Attorney R. Seth Wiliams said, "While it is clear that a physical altercation took place and several people were injured, there is insufficient credible evidence to determine which of the participants was the initial aggressor, or whether some participants were acting in self defense or in the reasonable defense of another."

The two injured off-duty police officers gave conflicting reports of what happened and drove themselves for medical treatment.  Although parts of the scuffle were captured on cell phones, how it started was not and the night club's surveillance cameras were not working.

McCoy is now free of criminal charges, but he still faces a possible civil lawsuit and he could be disciplined by the NFL under the league's personal conduct policy
