WYRK Taste of Country Risers “Battle of the Bands”

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.

 

  1. HOW TO ENTER

 

  1. These rules govern the WYRK Taste of Country Risers “Battle of the Bands” promotion (the “Promotion”) being conducted by WYRK (the “Station”) beginning on November 8, 2017 at 12:00am Eastern Time (“ET”) and ending on November 19, 2017 at 11:59pm ET.

 

  1. To participate in the Promotion, you may log onto wyrk.com and follow the links and instructions to enter the Promotion and submit your first name and last name, complete address, city, state, zip code, telephone number, year of birth and a valid email address in the online entry form. You must also include a picture of your band. Contestants who enter online may be contacted by the Station to request additional information including, but not limited to, names of the bands members, designated contact representative information, and .mp3 song demos or video file. Only one internet entry per person and one internet entry per email address is permitted.  Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address.  Multiple participants are not permitted to share the same email address.  Entries submitted will not be acknowledged or returned.  Use of any device to automate entry is prohibited.  Proof of submission of an entry shall not be deemed proof of receipt by Station.  Station’s computer is the official time keeping device for the Promotion.  The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems.  All entrants must agree to the Station’s online submission release in order to submit his or her entry.

 

  1. You may also enter via mail by mailing your band’s submission, including the signed Release (which can be found on the Station website) to the WYRK FM Promotions at 14 Lafayette Square #1200, Buffalo, NY 14203. You must also include your band’s bio, a picture of your band, and a two (2) song demo.  Entries must also include the band’s full name, names and dates of birth of all of the band members, a designated contact representative for the band and the complete address, phone number, and a valid email address for the designated contact.  Songs must be submitted in .mp3 format.  Submissions must be received no later than Friday, November 17, 2017 at 5:30pm. CT.  The Station is not responsible for lost, stolen, mangled, misdirected, postage due, illegible, incomplete or late entries.

 

  1. You may also enter the Promotion in person by dropping off your band’s submission, including the signed Release (which can be found on the Station website), to the WYRK FM Studios at 14 Lafayette Square #1200, Buffalo, NY 14203. You must also include your band’s bio, a picture of your band, and a two (2) song demo.  Entries must also include the band’s full name, names and dates of birth of all of the band members, a designated contact representative for the band and the complete address, phone number, and a valid email address for the designated contact.   Songs must be submitted in .mp3 format.  Submissions must be received no later than Friday, November 17, 2017 at 5:30pm CT.  The Station is not responsible for lost, stolen, mangled, misdirected, postage due, illegible, incomplete or late entries.

 

  1. One entry per band.

 

  1. ELIGIBILITY RESTRICTIONS

 

  1. The Promotion is open to all persons who are 18 years of age or older and who reside in the State of Texas. All members of each band must be 18 years of age or older and must also reside in the State of Texas.  Employees of the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, Station’s advertising and promotional agencies, its participating sponsors, other radio stations in the Dallas-Fort Worth metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win.  This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.

 

  1. Listeners are eligible to win a prize in a Promotion conducted by the Station only once every thirty (30) days and only once every six (6) months if the prize is valued over $600. Only one (1) winner per household is permitted in any Station promotion.

 

  1. The winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.

 

  1. There is no required number of members in a band. Solo acts will also be accepted.

 

  1. No member of any band may be signed to a fully executed major record label contract that guarantees the release of 1 or more albums/CD’s. Submitted entries must not have won previous awards, must not have been previously published, recorded or released and must not contain any other materials that may be restricted, prohibited, or outlawed by Federal, state or local laws, or materials that may otherwise infringe on the rights of a third party. The Station reserves the right to disqualify any entrant(s) if it determines in its sole discretion that the entrant’s performance (either in recorded form with the entry or live during the Final Event) contains material that infringes on the rights of another; indecent, pornographic, sexually explicit content, or otherwise offensive material such as aberrational behavior, graphic violence or drug abuse; or if such performance contains material that is deemed in the sole discretion of the Station to be unsuitable for public listening or radio broadcast.  All song entries will be screened by Station staff.  Clearance of a song entry by the Station does not relieve an entrant of its obligation to comply with the above representations.

 

  1. All entries become the property of the Station and none will be returned. Submission of an entry grants the Station and its agents a license in perpetuity to publish, use, adapt, edit and/or modify such entry in any way, in commerce and in any and all media, without limitation, and without consideration to the entrant.  The Station reserve the right, in its sole discretion, to cancel or suspend this Promotion should any causes beyond the Station’s control corrupt the administration, security or proper play of the

 

  1. All bands will be required to submit a Release along with their entries. Any band who has not submitted a Release will be disqualified.

 

  1. The winners must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize

 

  1. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements.  The Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

 

  1. PRIZES

 

  1. One (1) First Place Prize will be awarded. The First Place Prize is the opportunity to perform at WYRK Taste of Country at Coca-Cola Field on June 8, 2018, Jam in the Valley at Varysburg, NY on July 7, 2018, WYRK Fall Acoustic Show at University at Buffalo in September 2018. The time slots and length of performances will be determined by June 4, 2018. The Approximate Retail Value (“ARV”) of the First Place Prize is $0.00.

 

  1. The Station will contact the winning band regarding prize fulfillment after the conclusion of the Promotion.

 

  1. There is no substitution, transfer or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses.  Other restrictions may apply.

 

  1. WINNER SELECTION AND NOTIFICATION

 

  1. Decisions of the Station management with respect to the Promotion are final.

 

  1. Four (4) total bands (the “Finalists”) will be selected by a panel of three judges using the criteria of musical talent and ability, musical sound, and appropriateness of song selection. The four (4) Finalists will be selected on Monday, November 20, 2017 at approximately 9:00am CT. WYRK will notify the contact representative listed on each Finalist’s entry via email and/or telephone on November 20, 2017 at approximately 10:00am ET.  Any Finalist who cannot be contacted by November 20, 2017 by 3:00pm ET will forfeit his/her band’s participation in the Final Event and an alternate Finalist may be selected using the same judging criteria as set forth above.

 

  1. On Friday, November 24, 2017 starting at 7:00pm CT, two (2) of the selected Finalists will participate in the First Event at Santoras Pizza Pub & Grill located at 7800 Transit Road, Williamsville, NY 14221. On the day of the First Event, the two (2) selected Finalists must arrive and be registered with WYRK staff by 6:00pm ET.  Finalists will need to present a valid government issued ID at the time they register.  Finalists who have not registered by this time will be ineligible to participate in the First Event.  At approximately 7:00pm ET, the First Event will begin.  The order in which each of the two (2) selected Finalists will compete will be randomly selected by WYRK, in its sole and absolute discretion, prior to the start of the First Event.  In the order selected, the two (2) selected Finalists will each have approximately twenty (20) minutes to perform up to four (4) songs.  The songs performed must meet the eligibility requirements set forth in Section 2 of these rules or the Finalists may be disqualified at WYRK’s sole and absolute discretion. As each of the two (2) selected Finalists perform, the judges will be judging each Finalist’s performance.  Each Finalist will receive a score from each judge ranging from 1 to 10: “1” being “poor” and “10” being “excellent.”  Finalists will be judged on performance skills, quality of song selection, showmanship, musicianship, and overall performance.  Once all Finalists have performed, the judges will add up their scores.  A total of 30 is considered a “perfect score.” The Finalist with the highest score at the First Event will be deemed the First Event winner.  In the event of a tied score, audience applause will determine the winner.  The Station will request the audience to applause for each of the tied Finalists.  The Finalist receiving the greatest applause, as determined by the Station in its sole discretion, will be considered the winner for the place tied.  In the event of a tie through audience applause, the winner will be determined by random drawing of all tied Finalists.

 

  1. On Saturday, December 2, 2017 starting at 7:00pm CT, the two (2) remaining Finalists will participate in the Second Event at Say Cheese Pizza Co located at 1771 Love Road #2, Grand Island, NY 14072. On the day of the Second Event, the two (2) remaining Finalists must arrive and be registered with WYRK staff by 6:00pm ET.  Finalists will need to present a valid government issued ID at the time they register.  Finalists who have not registered by this time will be ineligible to participate in the Second Event.  At approximately 7:00pm ET, the Second Event will begin.  The order in which each of the two (2) remaining Finalists will compete will be randomly selected by WYRK, in its sole and absolute discretion, prior to the start of the Second Event.  In the order selected, the two (2) remaining Finalists will each have approximately twenty (20) minutes to perform up to four (4) songs.  The songs performed must meet the eligibility requirements set forth in Section 2 of these rules or the Finalists may be disqualified at WYRK’s sole and absolute discretion.   1. On Saturday, December 9, 2017 starting at 7:00pm CT, First Event Winner and the Second Event Winner will participate in the Final Event at Buffalo RiverWorks located at 359 Ganson Street, Buffalo, NY 14203. On the day of the Final Event, the First Event Winner and the Second Event Winner must arrive and be registered with WYRK staff by 6:00pm ET.  The First Event Winner and the Second Event Winner will need to present a valid government issued ID at the time they register.  The First Event Winner or Second Event Winner who have not registered by this time will be ineligible to participate in the Final Event.  At approximately 7:00pm ET, the Final Event will begin.  The order in which each of the First Event Winner and Second Event Winner will compete will be randomly selected by WYRK, in its sole and absolute discretion, prior to the start of the Final Event.  In the order selected, the First Event Winner and the Second Event Winner will each have approximately twenty (20) minutes to perform up to four (4) songs.  The songs performed must meet the eligibility requirements set forth in Section 2 of these rules or the First Event Winner or the Second Event Winner may be disqualified at WYRK’s sole and absolute discretion. As the First Event Winner and the Second Event Winner performs, the judges will be judging each performance.  Both the First Event Winner and the Second Event winner will receive a score from each judge ranging from 1 to 10: “1” being “poor” and “10” being “excellent.”  The First Event Winner and the Second Event winner will be judged on performance skills, quality of song selection, showmanship, musicianship, and overall performance.  Once both the First Event Winner and the Second Event Winner have performed, the judges will add up their scores.  A total of 30 is considered a “perfect score.” The band with the highest score at the Final Event will be deemed the Final Event winner.  In the event of a tied score, audience applause will determine the winner.  The Station will request the audience to applause for each of the tied bands.  The band receiving the greatest applause, as determined by the Station in its sole discretion, will be considered the winner for the place tied.  In the event of a tie through audience applause, the winner will be determined by random drawing of tied bands.

 

  1. IT IS AT THE STATION’S SOLE DISCRETION TO DISQUALIFY ANY FINALIST WHO IS DEEMED TO HAVE VIOLATED OR FAILED TO COMPLY WITH THE RULES OF THE CONTEST FOR ANY REASON.  PROFANITY AND VULGARITY IS PROHIBITED AND WILL RESULT IN IMMEDIATE DISQUALIFICATION.

 

  1. Winners do not need to listen to the Station to enter but the First Event Winner must be present at the First Event, the Second Event Winner must be present at the Second Event, and the Final Event Winner must be present at the Final Event to win.

 

  1. The winner must execute and return any required affidavit of eligibility and/or liability/publicity release by 11:00pm ET on December 9, 2017 or prize will be forfeited and the next runner up will be selected. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.

 

  1. CONDITIONS

 

  1. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station’s market) in a calendar year with an aggregate value of $600 or more.  Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.  Such winnings of $600 or more will be reported to the IRS.

 

  1. By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

 

  1. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.

 

  1. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate, suspend or modify the Promotion. If the Promotion is terminated before the original end date, the Station reserves the right to select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.

 

  1. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes.  If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.

 

  1. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.

 

  1. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.

 

  1. For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by December 9, 2017 to “WYRK Promotions – Taste of Country Risers Battle of the Bands Official Rules,” Attn: Promotions, WYRK, 14 Lafayette Square #1200, Buffalo, NY 14203.  For the names of the prize winners send a self-addressed stamped envelope for receipt by February 9, 2018 to the above address marked “Taste of Country Risers Battle of the Bands” – Winner List.”  The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and may be posted online at http://www.wyrk.com.

 

  1. PRIVACY

 

  1. By use of the Station’s website or by entering the Promotion through the Station’s website, you agree to the website’s Terms of Use Agreement located at wyrk.com and to the use of your personal information as described in the Privacy Policy located at wyrk.com.
