Zoom Tan Wins Lawsuit Against NYS COVID-19 Restrictions

Zoom Tan has successfully sued the state of New York over what it called unfair classification under the state's COVID-19 restrictions for "personal care" services.

The November lawsuit sought exemption, with the company claiming their business is contactless.

When Western New York first began Orange Zone restrictions, Zoom Tan locations were forced to close. Since the lawsuit, WIVB reports the governor changed the guidelines, "allowing personal care services to open at 25 percent capacity."

Zoom Tan's attorney Terry Conners told WIVB in November, "Zoom Tan provides a safe atmosphere and should not be shut down."

“Zoom Tan has a proven record of safety, a proven record of excellent hygienic conduct, in all their businesses they have over 70,000 clients. And not one has ever been reported to test positive for the coronavirus.”

According to WIVB, the court documents stated, "there is no proof that the chain’s salons’ ventilation system are worse than the ones at businesses allowed to operate in the state’s Orange Zone."
