The McKinley Mall used to be the best place to go see a movie in the south towns.  Now, they're afraid that the business isn't worth much at all.

Patrons who have gone to watch a movie at the McKinley Mall Dipson Theater in the past couple of months may have noticed a problem with climate control.  In the summer, it's very warm and in the winter it's incredibly cold. Now, the McKinley Mall is suing their landlord and saying that the diminished conditions are his fault.

According to WIVB, the climate control issues have been there since 2021.  They spoke with Zach Zurich, a liaison between the McKinley Mall cinemas and their landlord, Kohan Realty Investment Group, run by Mike Kohan.  Zurich says those problems began in September of 2021.  They were allegedly left unfixed for quite some time.  The theater even claims they offered to pay for the parts to have it fixed and work it into their rent agreement.  The lawsuit says that when the landlord did try to repair them, they used refurbished parts that didn't last long.  So they're back in the same boat again.

The theater’s attorney, James Graber at Rupp Pfalzgraf, says the theater wants no less than $4 million in damages because what was once a very profitable business is now worth nothing.

They've gone so far as to pass out blankets to their patrons in the wintertime because it will get so cold in the theaters.

The McKinley Mall theater is currently building its case against Kohan Realty Investment Group.
