
Landlords Must Provide Air Conditioning in New York State?
The weather is getting warm here in New York State. Some temperatures this week even though Spring is just beginning are getting to mid-to-high 70s.
It is that time of the year where you should have your AC unit checked out and tuned up to make sure that it is ready to go once the temps actually get to sweltering. If you wait, there could be a back up of scheduling because everyone is trying to do it at once. Plus, it is such a big cost and big investment for your home that you should make sure it is tuned up and properly working.
But, if you live in an apartment or landlord owned home in New York State, you might not have air conditioning. If you don't does your landlord need to provide you with air conditioning?
The answer is no.
The landlord is not responsible for keeping you cool. After all, being cool is a subjective question. Now, when it comes to heating in the house, that is mandated and a whole other situation, but when it comes to AC, it is not mandated by New York State.
According to New York State, the only thing that is required, temperature-wise, is heat. The law states that certain months of the year is when heat is required in New York State landlord owned apartments. Heat must be supplied from October 1 through May 31 to tenants in multiple dwellings. New York State has given more rights to landlords if there are not tenants paying or fulfilling their contract, there are given ways that eviction can be granted in New York State.
