Certain Sparklers New York State Doesn't Want You to Have Anymore

There are brand new firework laws that all New York State residents need to know for 2026. New York State has banned certain sparklers for kids AND adults.

It can be confusing for some in New York State when it comes to fireworks. Back in the day, people would have to go to Pennsylvania to go buy fireworks because they couldn't be sold in New York. Now, they are legal, well some of them, and during certain times of the year, by certain people. See--confusing.

Fireworks such as firecrackers, bottle rockets, Roman candles, spinners, and aerial devices are illegal in New York State to use for personal use at residential homes. Also, the sparklers with the metal rods are now illegal to have in New York State. The only sparklers that are approved in New York State are the ones with the wooden dowels, so if you see a store selling the metal rod ones, those are not legal.

Sales of Sparkling Devices by certified permanent and specialty retailers can only occur from June 1 to July 5 and December 26 to January 2, according to the New York State site in most counties.

There are about 125 firework related injuries that send people to the hospital every year in New York State during the 4th of July and nationally, there are more than 19,000 calls because of fireworks that have caused fires. According to the New York State website:

According to a report from the U.S. Consumer Product Safety Commission, there’s been an upward trend in fireworks-related injuries, with incidence increasing by 25 percent within a six-year time period. The Consumer Product Safety Commission also found that nationally nearly half of the fireworks-related injuries were to people younger than 24 years of age.
