New York State Bans Towns on Making Pitbulls Illegal
New York State has made a law that states towns and municipalities CANNOT ban certain dog breeds.
A lot of people, even some who love dogs, don't like certain stereotypical dog breeds, such as pitbulls and some towns and villages want to have them banned from getting a license, but New York State says no.
Although New York State is mandating towns and villages not to have any laws on whether or not people can OWN certain breeds, there are some laws that New York State has in place on WHERE your dogs can go.
Historically, homeowners faced "bans" on specific breeds (like Pit Bulls or Rottweilers) because insurance companies refused coverage. A state law protects owners by prohibiting insurance companies from cancelling, refusing to issue, or increasing rates on a homeowners' policy based solely on a dog's breed", according to the Animal Legal and Historical Society.
Should dogs be allowed at patios at restaurants over the Summer?
New York State does make sure that dogs are not allowed inside or restaurants. There is no expectation to that law according to the New York State Health Department unless they are a service dog. Though, dogs are allowed to go onto outdoor spaces that have food at restaurants, such as a patio.
It is important to note that New York State does not tell restaurants whether or not they need to accept dogs on a patio. A restaurant can deny animals on the patio, unless it is a service dog.
Do you mind it when dogs are on a patio while you are eating dinner? It all depends on the dog and if it is behaving, but it can certainly be inconvenient if you are trying to eat and a dog is not on it's best behavior while you are trying to have a meal.
