New York State is allowing landlords to charge tenants for this and it seems like it should be something that is standard in the house. There can be a mandatory $50 for EACH of these that you have installed in the apartment.

Tenants are mad that this new law in New York State will charge them a significant amount of money and they have no say in the decision. New York State is allowing landlords to charge tenants $50 to reimburse for every carbon monoxide that is newly installed in an apartment or rented home. What is the law when it comes to carbon monoxide inside the house? New York State lays out all of the details really well about what both the landlords and the tenants need to know about having carbon monoxide:

Landlords:

  • It is up to you to make sure that there are carbon monoxide detectors or combos within 15 feet of the primary entrance to each sleeping room
  • Combination smoke/carbon monoxide detectors are allowed.

Here is how much Landlords can change Tenants for Carbon Monoxide detectors:

  • A landlord is entitled to be reimbursed a maximum of $50.00 for such combination detectors only when the smoke alarm needs to be replaced
  • If the smoke alarm is operable and the landlord wishes to replace it with a combined alarm, the landlord can only be reimbursed $25.00

In addition, tenants are legally allowed to be asked to chip in and pay for smoke detectors that are installed by the landlord and owner. There is a cap, though on how much they can ask for. Landlords can only ask for only $10 per smoke alarm that is installed. You can see all the details here and whose responsibility it is to take care of the smoke and fire alarms and whose responsibility it is to change the batteries.
